Is it still defamation if its true? Customer complaints are not defamation of character last I heard.

No, it is not 'defamation' if certain people have merely given a true and honest account of their own personal experiences.

What really gets me, is the irony of it.
I mean, when you have developed a reputation of failing to respond to requests and failing to communicate, then of course the best way to solve this and to improve your reputation is to, erm, communicate? - and not immediately make heavy (and hollow) threats about legal action against your customer base?  I think that alone says it all.....

In my case, I have given over a hundred pounds of my extremely hard earned to this outfit, as my first transaction at that, and after 10 weeks, I have received no goods at all, no response to any one of my 8 attempts to contact them and now I see a threat on their site discussing legal action, etc.

Boystown, this is not defamation, this is the TRUTH.

MB I completely agree.  I think this company should read the Distance Selling Regs regarding insurance as well:

Can I charge the consumer the cost of insuring items that 
I send out?
3.20 No. These items belong to you until they have been accepted by your
consumer. So you cannot charge your consumers for carrying risks
that you should bear. See paragraph 3.36 for more information.

Can a consumer cancel an order before they receive the
goods or where goods are lost in transit? 
3.35 Yes. Where the DSRs give consumers rights to cancel, this right is
unconditional. If consumers cancel before they have received the
goods you must refund the total price of the goods, including any
delivery charges. Consumers who have cancelled under the DSRs
may refuse to accept delivery of the goods. Refusal in such a
situation cannot be treated as a breach of contract.
3.36 Where goods are lost in transit from you to the consumer you will
need to either send new goods or offer the consumer a full refund,
including delivery charges. See paragraph 3.20 for more information.

Threats like the one they have posted are mostly "Paper Tigers" IMHO. As a rule, the online stores I use as well as paypal, EBAY, and Amazon all welcome comments and evaluations from customers. As you know--they request ratings. EBAY sellers are rated according to reviews by customers. An occasional problem with an order/payment/communication is normal, but Genessis is not the only site discussing BTMM and the multiple problems going on. When the orders go wrong and communication is dropped, its a sure sign of bad problems, and what follows is called "social media"---its the double edged sword of an online business. Too bad for all parties involved.

My Head Hurts, with all these new email addresses...LOL

Right I gave them the benefit of the doubt with an order I had last year, an Eduards 1:48 scale royal class kit reviewed on this site, and I must say the kit is superb, but took forever to get here, so after many phone calls & e-mails I finally got the kit at a good price. I haven't made any of the 2 spitfires yet, but use the Glass at weekends for a lemon aid while watching the footy...LOL.

But
have used them twice since April and have had no problems, so far.
I got the Danger Zone Tomcat for a great price and delivered within a week, and I have just ordered 2 more kits at 50% off on a 1:48 scale Hobby Boss F-18 Hornet and a 1:48 Hobby Boss F-14D,
So I will report on them when they arrive later this week, I think they have sorted out most of their problems, the only difference with this purchase is that they no longer use PayPal, so I paid with CC to protect my cash.

will keep you all posted.
